IR Reforms: Labor\‘s plan to 2010

In this first article of 2008 we review the proposed Rudd IR reforms, what they are and when they are anticipated to occur.
National Employment Standards
There will be 10 minimum employment standards. Additions to the present minimum standards are shown in italics:
Annual Leave
4 weeks per annum and an extra week for 7 day, 24 hour shift workers.
Personal Leave
Consisting of 10 days sick leave, carer’s leave, compassionate leave (for bereavement and critically ill family/household members) and 2 days emergency services leave.
Parental Leave
Up to 12 months unpaid plus a further 12 months unpaid upon request of employee.
Community Service Leave
Leave for defined community activities such as jury service – it is not clear whether or not this will be paid leave.
Long Service Leave
Based on the existing applicable state standard.
Public Holidays
As per current standard
Notice on Termination
As per current standard
Severance Pay
In addition to notice in cases of redundancy and will apply to employers who employ more than 15 employees.
Hours of Work
38 ordinary hours a week plus reasonable
additional hours.
Flexible Work for Parents
Right for an employee to request flexible start/finish times up until a child’s school age.
Information
The obligation to provide all employees with written information about their rights under the new laws.
When do they commence? Legislation will be introduced early in 2008, but proposed to operate from 1 January 2010.
